Can UK & Irish Citizens Legally Own Florida Property?
Yes. Foreign nationals can buy and own real estate in Florida.
You do not need US citizenship, a Green Card, a work visa, or permanent residency.
International buyers regularly purchase holiday homes, investment properties, rental properties, and future retirement homes. Your ownership rights are generally very similar to those of a US citizen.
How Is Buying In Florida Different From The UK?
There are some important differences. In the UK, solicitors typically manage most of the legal process. In Florida, transactions are usually handled through licensed title companies, real estate attorneys when needed, real estate professionals, and mortgage lenders if financing is involved.
The title company plays a major role. They help ensure the seller legally owns the property, existing liens or issues are addressed, closing documents are prepared, money transfers are securely handled, and ownership is correctly recorded.
Is My Deposit Protected?
Your deposit can be protected, but it is not automatic in every situation. In Florida, the protection depends on the purchase contract, who is holding the escrow deposit, the inspection and financing deadlines, and whether the buyer follows the cancellation rules in the contract.
Earnest money is usually held by a title company, attorney escrow account, or approved brokerage escrow account rather than being paid directly to the seller. If you cancel within a valid contract contingency period and give notice correctly, the contract may allow the deposit to be returned. If deadlines are missed, notice is not handled properly, or there is a dispute, the deposit may be delayed or contested.
Before sending any deposit, make sure you understand the escrow holder, the exact cancellation deadlines, what must be done in writing, and what happens if either side defaults. What Happens After My Offer Is Accepted?
1. Contract Signing
The purchase agreement outlines price, deposit amount, important dates, buyer protections, and seller obligations. Many contracts can be signed electronically.
2. Inspection Period
You normally have time to inspect the property before fully committing. Common inspections include home, roof, termite, pool, and insurance review.
3. Title Search
The title company researches ownership history and checks for ownership disputes, unpaid liens, and recording problems.
4. Final Approval
If financing is involved, the lender completes final approval.
5. Closing
Final documents are signed, money is transferred, ownership changes hands, and the property becomes yours.
And yes, many overseas buyers close without being physically in Florida.
Can I Buy Without Flying To America?
Yes. Many UK and Irish buyers purchase remotely. The process can include video property tours, electronic signatures, online document review, secure money transfers, and remote closing services.
You can literally buy a Florida property while sitting at home drinking tea. Although we do recommend visiting Florida eventually. The beaches get offended if ignored.
Should I Buy Personally Or Through A Company?
This depends on your individual circumstances. Some international buyers purchase personally. Others consider structures such as Limited Liability Companies, trust structures, or other ownership arrangements.

Understanding FIRPTA
One term foreign buyers often hear is FIRPTA, the Foreign Investment in Real Property Tax Act. This is a US tax law affecting foreign owners when they sell property.
FIRPTA does not stop you buying property. When a foreign owner sells US real estate, a percentage of the sale proceeds may be temporarily withheld to ensure any required taxes are paid. With proper advice and planning, this is a normal part of international ownership.

Do I Need A US Will Or Estate Planning?
Possibly. Owning property in another country means you should consider how that asset fits into your overall estate planning. Professional advice may help with ownership structure, inheritance planning, and future transfer of property.
Do I Need Insurance?
Yes. Florida property owners typically carry insurance. Depending on location and property type, this may include homeowners insurance, hurricane coverage considerations, flood insurance where applicable, and liability coverage.
